3 for 3 WINS IN A ROW!!! Debt Collectors tucking tail and run away…
Success Story
The first of my 3 debt collector Court wins began last fall when the Trial Date for a Warrant in Debt was fast approaching – Nov. 21st. I’d delayed in pursuing remedy feeling a bit stuck in not knowing what to try. I saw one of Joe Lustica’s videos on debt discharge where he shares a handwritten letter he had written in response to a medical bill that a third part debt collector was seeking collection on. I wrote that letter up customizing to my situation of course and hand delivered it to the law office nearby that was handling my case – the day before the Trial date. Ther person at the attorney’s office said my documents wouldn’t make any difference with the court proceedings the next day, but I said, that’s alright – they just needed to take them. When I went to the Court house the next morning my case did not appear on the docket and I was directed to the Clerk’s Office. There the clerk looked up the case and let me know it had been non-suited that morning and explained what that meant – that the plaintiff had 6 months to restart the process all over again. I took that as a WIN and that 6 month window has expired without any further action from that debt collector. My next two cases which just completed – May 26 and June 1st respectively – both concluded in non-suits as well – YAY – Win Win Win!!! The plaintiffs in both cases withdrawing their suits. In these two most recent cases I was helped tremendously by Coldstream Ministries’ Jennifer Caldwell and her husband Daman. I met them after joining Joe Lustica’s Liberty Foundation about 5 months ago. I worked closely with Jennifer who patiently educated me on the legal concept of the Business Exemption Rule and how to apply it in my cases. I did my initial drafts of my case pleadings and received excellent feedback and suggestions from both she and Daman – giving laser like tweaking which deepened my understanding of the validity and solidness of my defense and the actual lack of admissible evidence the plaintiff had provided as their proof of claim. Wow. Soooo empowering. I was so confident and grounded in the essentials of the case from the coaching I received by Jennifer that I was actually looking forward to being cross examined by the plaintiff’s attorney and then having the opportunity to cross examine them. I guess my theatre experience was kicking in – I was anticipating a loosely scripted improv opportunity. : ) As it turned out I was equal parts triumphant and disappointed when May 26 arrived and upon entering the Court House did not see my case on the docket. Shucks darn! Non-Suit AGAIN!!! Simultaneously exultant in this second victory, my disappointment was easily consoled by the euphoria of this obvious WIN – now 2 for 2!!! Less than a week to go for the June 1st case. In this last of the three, it was the same plaintiff as in the May 26 case, however, they had not bothered to have any proof of claim at the initial hearing to present to the Court and then that plaintiff chose not to comply with the Court’s Order to submit a Bill of Particulars – so, surprise, surprise – NOT – upon inquiring with the Court Clerk’s office I found that they – the plaintiff, were intending to non-suit in this case, which they did. So, in this final case I did not need to actually go to the Court House on the scheduled trial date as the status of non-suit had been updated in the case on the website. 3 for 3!!! YAY!!!! I highly and unreservedly recommend Coldstream Ministries – Jennifer and Daman Caldwell. They are brilliant, compassionate, kind and patient. They have a wealth of knowledge and personal experience in the subject matter and it was a delight to work with them. I intend to continue to do so as I pursue further remedy in the next steps in these cases – which is exploring how to actually extinguish these accounts absolutely. Daman and Jennifer Caldwell have graciously spent hours on the phone with me to guide and help me through this debt collection case that is still ongoing. Jen has spent her time, energy, and effort to write me up responses to the debt collectors to record for my case. I’m very confident that with all the help and guidance I have received from Daman and Jen that I will have no issues getting this case dismissed on the next hearing. Daman and Jen have also taken time out of their day to help me fill out the form to get my Foreign EIN so I can start my own Ministry. Daman and Jen have spent countless hours with me on the phone explaining court processes, tax forms, bonds, and processes that are not public knowledge.
